Booking and cancellation terms
Working framework to be validated by a lawyer (consumers and professionals, France and Monaco). Values in brackets are still to be decided. In case of discrepancy, the French version prevails.
1. Provider and scope
[Company name, registration, VAT, contact]. These terms govern private chef, catering and related services.
2. Quote
Each quote states the date, the venue, the proposed chef or how one is assigned, the menu, the number of guests, the staff, the produce, the equipment, travel, taxes and the total price, as well as its validity period.
3. Formation of the contract
A booking is confirmed once the quote has been accepted in writing, the deposit paid and the provider has confirmed in writing. These terms are provided before any commitment, on a durable medium.
4. Payment
A deposit of [%] is paid on booking. The balance is due [deadline]. Payment methods: [list].
5. Changes
The final number of guests and the menu are confirmed no later than [deadline] before the service. Any change is agreed in writing; any extra cost is stated before acceptance.
6. Cancellation by the client
Schedule [to be defined, with no overlapping periods], stating whether costs already incurred are included. The amount retained can never exceed the price of the service.
7. Chef and replacement
The proposed chef is named in the quote. If unavailable, a chef of a suitable level is proposed; where the named chef is an essential part of the contract, any replacement requires the client’s agreement.
8. Cancellation by the provider
Sums paid for services not provided are refunded, without prejudice to the client’s legal remedies.
9. Right of withdrawal
Catering services provided on a specific date are excluded from the right of withdrawal (French Consumer Code, art. L221-28). This exception is checked for each additional service.
10. Force majeure
Assessed under article 1218 of the French Civil Code. The parties first seek to reschedule.
11. Venue, allergies, hygiene
The client provides access to the venue and a working kitchen. Allergies are notified in writing and assessed before confirmation; the provider takes appropriate preventive measures.
12. Complaints and mediation
Complaints to [email]. Consumer mediator: [name, contact details, website].
13. Governing law
French law, subject to mandatory consumer-protection rules.
